Probate Attorney

Knoxville Probate Attorneys for Executors and Families

We Handle the Court Filings, Notices, and Deadlines So You Can Focus on Your Family

Serving as executor means court filings, creditor notices, and deadlines, all while you’re grieving. An executor is called a personal representative in Tennessee law, and the role carries legal duties that are easy to get wrong the first time.

Betz & Baril guides Knoxville families through uncontested probate from the first filing to the final closing. Linda Garner Betz spent more than a decade in the courtroom, and she and Jason Baril bring more than 35 years of combined legal experience. They explain each step in plain language and keep you informed along the way.

Probate Services for Executors, Beneficiaries and Heirs

Every estate is different, but most uncontested probate in Tennessee involves these steps.

Opening the Estate and Getting Court Authority

We prepare and file the petition to admit the will and have you appointed. The court then issues letters testamentary, or letters of administration if there’s no will, which give you legal authority to act for the estate. We also explain the bond requirement.

Creditor Notices and Claims Handled on Tennessee’s Timeline

Creditors generally have four months from the first published notice to file claims, and most claims are barred twelve months after death. We help you send the required notices to known creditors and review claims before you pay or distribute anything.

Inventory and Records Kept Current

Tennessee generally requires an inventory of the estate’s assets within 60 days of your appointment. We help you identify, value, and list the assets, and keep the records you need to close the estate.

Executor Guidance on Your Duties and Deadlines

Serving as executor carries legal duties, and mistakes can create personal liability. We explain what you must do, what to avoid, and when to wait, such as holding distributions until the creditor period has run.

Small Estate Proceedings for Estates of $50,000 or Less

When a decedent’s probate personal property is worth $50,000 or less, Tennessee offers a simplified court process after a 45-day waiting period. It doesn’t cover real estate, so we first check which process fits your situation.

Clear Communication With Heirs and Beneficiaries

We help executors keep heirs informed about the estate’s progress, timing, and distributions, which prevents misunderstandings later.

Betz and Baril is helping me with the Mastercard/Visa/Discover settlement that has been ongoing for a while now. Every couple of months, I have gotten an update call from either Addison or Charity, just to keep me in the loop of how things are progressing. Both of these wonderful people are so kind and have gone out of their way to answer any and all questions I have. Plus, they both have excellent personalities which is a welcomed change from most people I speak with who are in customer relations services. Thank you, Betz and Baril for all you’re doing to help me with this settlement. I’m very thankful and will most certainly use your law firm again in the future, if need be.

Betz and Baril have been one of the best law offices I've ever had the pleasure to work with. They have been helping me navigate the confusing waters of the MasterCard/Visa class action law suit. They have gone out of their way to find the important data for me and have regularly taken the initiative to stay in contact with me. Every employee I've had contact with has been helpful. Most recently, my experience with a team member named Charity was just one more positive experience with the firm. Thank you Betz and Baril!

Answering Commonly Asked Probate Questions

How long does probate take in Tennessee?

Creditors have at least four months from the first published notice to file claims, so even a simple estate takes longer than that. Many simple, uncontested estates take roughly six to nine months. Real estate, taxes, and complicated assets add time.

Letters testamentary are the court document naming you as executor and giving you legal authority to act for the estate. Banks, title companies, and other institutions will ask for them. If there is no will, the court issues letters of administration instead.

Usually, yes. Tennessee generally requires a personal representative to post a bond before the court issues letters. Exceptions exist, including when the will waives the bond. We check your will and explain what applies.

Yes. The Probate Division provides forms for people who open an estate on their own, but court staff can’t give legal advice. Missed notices, late inventories, or early distributions can create personal liability for the executor, which is why many people hire an attorney.

Possibly. If the decedent’s probate personal property is worth $50,000 or less, a simplified small estate process is available 45 days after death. It doesn’t cover real estate, and assets that pass by beneficiary designation or survivorship never go through probate.
